Welcome to Firetell. Please read these Terms of Service ("Terms") carefully before using the Firetell website (https://firetell.com) and the cloud communications services, APIs, and applications provided by Firetell ("Service", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
 

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you represent that you are at least 18 years old and have the legal authority to bind yourself or the entity you represent to these Terms.

2. Description of Service

Firetell provides next-generation VOIP and cloud communications platform solutions, including but not limited to Virtual PBX, SIP Trunking, Smart IVR, Voice AI, and call recording systems. Services are provided based on the subscription plan selected by the user.

3. Account Registration & Security

  • Account Creation: To use certain features, you must register for an account and provide accurate, current, and complete information.
  • Account Responsibility: You are entirely responsible for maintaining the confidentiality of your account credentials (username and password) and for any and all activities that occur under your account.
  • Unauthorized Use: You agree to notify Firetell immediately of any unauthorized use of your account or any other breach of security.

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Engage in illegal telemarketing, automated cold-calling, or "robocalling" violating local and international regulations (such as TCPA, GDPR, etc.).
  • Transmit any materials that contain viruses, malware, or malicious code.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity (spoofing).
  • Interfere with or disrupt the integrity or performance of the Service or third-party data contained therein.

5. Fees, Billing, and Refunds

  • Pricing: Grounded on our current pricing structures, plans are billed on a subscription basis (monthly/yearly) per agent or usage scale.
  • Payment: You agree to provide valid billing information. Failure to pay fees when due may result in the suspension or termination of your access to the Service.
  • Refunds: Except as required by law, all fees are non-refundable.

6. Service Availability & Downtime (SLA)

While Firetell strives to offer a 99.9% Guaranteed Uptime, the Service is provided on an "as is" and "as available" basis. Temporary downtime may occur due to scheduled maintenance, upgrades, or emergency infrastructure fixes.

7. Data Privacy & Compliance

Your privacy is important to us. Firetell processes data in compliance with our Privacy Policy and applicable data protection regulations (such as GDPR). By using the Service, you consent to the collection and use of data as outlined therein.

8. Intellectual Property

The Service and its original content, features, functionality, logos, and API frameworks are and will remain the exclusive property of Firetell and its licensors. You may not replicate, modify, or distribute our intellectual property without prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Firetell, its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

10. Termination

We reserve the right to terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation a breach of the Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated terms on this website. Your continued use of the Service after any revisions become effective constitutes your agreement to the new terms.
